Free Carmen Villalba! Joint statement by Communist Parties denounces the Paraguayan government

In a joint statement titled "For the validity of the rule of law: freedom for prisoners with completed sentences", Communist and Workers' Parties denounce the illegal detention of Carmen Villalba despite the fact that she has completed all her prison sentences.

The undersigned Communist and Workers Parties denounce the Paraguayan government to the international community for the illegal detention of Carmen Villalba, who is still being held in the Asunción Women's Prison, in Paraguay, despite the effective fulfillment of her sentence.

In this regard, we note that Carmen Villalba was sentenced by a final judicial sentence to 15 years in prison plus 3 years for security measures, having served said sentence in July of this year and obtained a resolution of freedom for embezzlement in this case. In the same way, a firm sentence to 17 years in prison weighs on her in a case that, being extinct, should never have reached a sentence. In this case, Carmen Villalba has also exceeded 17 years of sentence, on July 4 of this year. Since then and to date, her legal defense has requested her release by compurgation, a procedure that has been subject to an unjustifiable and illegal delay, considering the constitutional guarantees at stake, such as freedom of movement, the principle of legality, among others.

In this regard, we first recall that Carmen Villalba was apprehended on July 2, 2004, remaining in preventive detention by order issued by the prosecutor Carmen Meza on February 28, 2005, within the framework of case 1129. Notwithstanding this , the criminal execution judge N ° 3 of Luque, instead of ordering the immediate release by compurgation of the sentence in its entirety, issued a resolution in which the nature of the detention of origin is unknown. All of this, based on mere formalities and in open contradiction with the provisions of the legislation that refers to the final calculation of penalties, taking into account the day of restriction of freedom (art. 494 Code of Criminal Procedure).

We consider that Carmen Villalba’sstate of detention constitutes an arbitrary situation and contrary to the rule of law, since she has fully served her sentence, duly established with the same law that is being violated today by not allowing her freedom. In addition, the context in which the restriction of Carmen Villalba's freedom is arbitrarily delayed significantly aggravates the situation.Her daughter Carmen Elizabeth "Lichita" is disappeared since last November, her sister Laura was arrested and her nieces María Carmen and Lilian Mariana were murdered in September 2020, mournful events that add to the murder of her son Néstor and the refuge in Argentina of several of his relatives due to harassment by the Paraguayan security forces.

For all the above, the national and international community demands the immediate release of Carmen Villalba, considering the fulfillment of her sentence. This situation, if it persists, exposes the Paraguayan State to responsibilities for violation of constitutional guarantees and human rights treaties.

Libertad a los presos con condenas cumplidas

Los Partidos Comunistas y Obreros abajo firmantes denunciamos al gobierno paraguayo ante la comunidad internacional, por la situación de detención ilegal de Carmen Villalba, quien aún se encuentra recluida en la Cárcel de Mujeres de Asunción, Paraguay, pese al cumplimiento efectivo de su condena.

Al respecto, señalamos que Carmen Villalba fue condenada mediante sentencia judicial firme a 15 años de prisión más 3 años de medida de seguridad, habiendo cumplido dicha condena en julio de este año y obtenida resolución de libertad por compurgamiento en esta causa. De igual manera, pesa sobre ella una condena firme a 17 años de prisión en una causa que, por estar extinta, nunca debió llegar a sentencia. En esta causa, Carmen Villalba también ha sobrepasado los 17 años de condena, el 4 de julio de este año. Desde entonces y hasta la fecha, su defensa legal solicitó su libertad por compurgamiento, trámite que ha sido objeto de una dilación injustificable e ilegal, considerando las garantías constitucionales en juego, tales como la libertad ambulatoria, el principio de legalidad, entre otros.

En tal sentido, recordamos primeramente que Carmen Villalba fue aprehendida el 2 de julio de 2004, quedando con detención preventiva por orden emanada de la fiscal Carmen Meza en fecha 28 de febrero del 2005, dentro del marco de la causa 1129. Sin perjuicio de ello, la jueza de ejecución penal N°3 de Luque, en el lugar de ordenar la inmediata libertad por compurgamiento de la condena en su totalidad, emitió una resolución en la que se desconoce el carácter de la detención de origen, con sustento en meras formalidades y en abierta contradicción con lo previsto en la legislación que refiere al cómputo definitivo de las penas, debiendo tomar en cuenta el día de la restricción de libertad (art. 494 Código Procesal Penal).

En ese orden, consideramos que el estado de detención en el que se encuentra la Carmen Villalba constituye una situación arbitraria y contraria al Estado de Derecho, puesto que la misma ha cumplido íntegramente la condena, oportunamente fijada con la misma ley que hoy se violenta al no permitirse su libertad. Además, el contexto en que se aletarga por vía arbitraria la restricción de libertad de Carmen Villalba, como la desaparición de su hija Carmen Elizabeth "Lichita" desde noviembre último, el arresto de su hermana Laura y el asesinato de sus sobrinas María Carmen y Lilian Mariana en septiembre pasado, luctuosos hechos que se suman al asesinato de su hijo Néstor y al refugio en Argentina de varios de sus familiares, por hostigamiento de las fuerzas de seguridad paraguayas, agrava notablemente el escenario.

Por todo lo expuesto, la comunidad nacional e internacional exige la inmediata liberación de Carmen Villalba, considerando el cumplimiento de su condena; situación que de persistir expone al Estado paraguayo a responsabilidades por violación de garantías constitucionales y de tratados de derechos humanos.
